i think you have found the location to dump the motor comming out of the EB ;)

Fact is to change the locks he had to enter the house, which in the 1st instance is trespass. He is in way over his head. Keep your cool, don't do anything rash and keep level headed about what you do, last thing you want is any repercussions(sp).

Hope it all pans out guys, land lords can be right bastards some times (99% are good, like allthings, theres allways one doozy who screws it for the rest of us).

Call the cops and ask advice, at least you will know you are operating within the law then, so if things get worse you can be sure you will not be in the crap instead of him, remmeber dumb criminals can have dumb luck

Thanks, yeah, we do seem to have had a run of back luck over the past year or so, but like I always say, things can only get better, and I'm positive they will, sooner or later.

Besides, a lot of it could be looked at as learning experiences - we've certainly learnt to never rent privately again, always through an agent, agents may not be perfect, but I doubt they would do so many things that are simply illegal like the slum lord landlord has.

I've also learnt with the times that my Escort was vandalised that no matter how old your car is, if it's your pride and joy, there is likely to be someone out there who doesn't respect it (and is quite possibly jealous of it) who won't think twice about damaging it, and so I have learnt the value of a good alarm system and insurance.

What's the saying? "Those who do not learn from history are destined to repeat it" - which to me at least tells me to learn from what happens in life.

And the slum lord landlord will certainly be learning that if he does the wrong thing, he can't get away with it!

If you qualify go to Legal Aid and get advice quickly.

Definately don't go private rental again. At least you've got assistance from the tenancy tribunal etc if you are renting through an agent.

Whats the real estate agent doing? Surely the real estate agent can let you in to get your stuff since your lease is still current. You should have waited to hand the keys back till the last tenancy date.

I had a few issues with a rental I used to have. The house was originally mine. I sold it and rented it back while I built a new house. The real estate agent was telling me I have to remove/clean up stuff etc. I told the real estate agent "I used to own this house","The sale agreement was sold as is" and I did nothing as I had the sale contract

Refer to your lease contract.

Yeah, I'd steer clear of private rentals. I've heard too many bad stories about going that way with rentals.

Private rental, no real estate agent involved. And we hadn't handed back the keys yet, so obviously he had another set of keys to the house (as well as the key for the alarm to disable it from the outside without the remote for it), which is creepy when I think about it - he could have got in there any time we were not home and done whatever he wanted...

I wouldn't be surprised if he was/had been in the house without you knowing. A shady character indeed.

Yes, and considering the thefts we experienced while living there and the fact that the police never found any fingerprints on any of the windows that could have been used to gain entry, and there was no sign of forced entry... Hmm... Pity we couldn't possibly prove it or give enough evidence to the police to have them do anything - no doubt they'd say it's circumstantial (spelling?!?) evidence and not enough to have them investigate...

Any luck as yet? I saw your edited post and I really dont think you need to offer $$$ to people to come and help, what about family, friends etc? Surely there must be a few people you can get together.

Failing that, call the police again and say there's been a breakin, explain the situation and have them watching while you cut the locks off, get your things and leave.

That is the biggest load of crap i have ever heard, **** the landlord, cut the locks and take your stuff back. If i was in melb i would be happy to help, hell if u lived in bundy i could organise you a truck, etc to get your eb / spare engine back.

Jeez when you left I thought,theyv'e done everything right and good on them for their patience now its all over and they can get on with life but it aint to be aparently. Firstly what did the police say about you retrieving your goods by breaking in to the house, after all you are still legally the tennant. I guess you will again take him to tribunal because he has breached conditions of his court hearing. If you break in and he goes to police surely they will then tell HIM its a civil matter and they can't help. Then if he sends you the bill, in your financial situation, how on earth are you going to pay it. Tell him "we'll see you in court". He will then see the other end of the stick.

Today started off with a call to consumer affairs who put me through to VCAT, they told me to come into the city (Melboune) to get a restraining order and an urgent hearing.

After no sleep last night I thought I CBF but went in anyway, VCAT were very sympathetic to my plight, the arbitrator was a bit narky at first, then he read the previous orders against my landlord. None of which he has complied with, he immediately granted an intervetion order and also ordered that the house be opened immediately and faxed a copy of the order to Sunshine Police station (herein lies my mistake). They are a bunch of f***wits!!!!

I was told to attend the station have a Police officer call the landlord and for them to tell him to open the house and accompany me to the house whilst I removed my belongings at an agreed time (between the Police and I). Good old c*nstable calls the landlord, the landlord refuses to open the house, c*nstable hangs up.

"NOTHING I CAN DO" he says!!!

I can't make him open the house, and we're not going around to his house (the order stated that if he refuses to comply the Police are to attend his house). "I'm not here to f*cking babysit you." say's c*nstable plod as I try and point out to him that there is an order that the Police must attend his premises if slum lord and son do not agree by phone to open the house immediatley. He then hit my hand away from the order and said he didn't have to do ANYTHING! Is this not abuse by a Police officer?, I was polite, never raised my voice or swore at him let alone failing to carry out their duties that were ordered by a judge.

I was told to go to a clinic or hospital for insulin that's in the house, helf*ckinglo!! It is nearly impossible to get insulin from any Doctor that has not seen you previously or knows of your condition as they assume that you are either selling it to make money or giving it to a body builder.

I then said that I wanted to file a stolen vehicle report as well as other stolen property, c*nstable complete ******** then says, "It's not f*cking stolen, you know where it is." I tried to point out that I cannot access the car, it is not the slum lords car to lock up, let alone any other of my belongings.

He walked off laughing into the one way mirrored office.

So it's back to square one I have to cancel the tow truck, van and engine hoist that my dad was going to get for me tomorrow and contact VCAT (and possibly attend another urgent hearing).

Meanwhile my belongings sit in this arseholes house, because I know if I go around there and break in, I would be lucky enough to get caught and then I would be up on charges of breaking and entering, theft etc even though the things I take are mine and lease is still in MY F*CKING NAME!!!!!

I'm cold, I'm tired, and I'm way beyond f*cking ****ed off!!

In regards to shifting the car & engine, have you looked into hiring a car trailer with a winch on it? you could use the winch to put the engine on the trailer by running it up the ramp.

Surely if your name is on the lease for a few more days, or weeks? then if youre entering the property to get your belongings, no one could consider that breaking & entering???

To tell you the truth I don't know anymore. The locks are changed so if I took a drill to them or even kicked the doors in (it wouldn't be hard), the landlord would go straight to the police and I'd be charged with something. If you got plods name then ring police station later and ask if he is there then if not go back and ask again, If no response take it higher surely they have to comply with the order. I can't believe the sh** you are going through.
Maybe when ringing back ask to speak to seargent on duty not a constable.

or go back in there... if plod is there, talk to him again.. repeat waht you sed about the fax yada yada yada, and if he does the same thing, ask for his FULL NAME and BADGE number.. when he asks why tell him its for the FORMAL complaint.. at least in WA here if you make a formal complaint it goes on their record regardless of whether anything happens about it.. similar legal weight to a stat dec i spose..

If you can afford the cost (which wouldnt be much) cut the lock and break a window. Its still your house so you "lost your keys so you had to get in somehow". Then get the lock and window replaced. whats a window cost these days?

I dont think there us anything illegal in this at all. If it is still your house, you can do pretty much whatever you want, but of course the house must be returned to the landlord in the condition it was given to you, blah, blah, blah....

what day are you looking at getting into the house now? During the week I could offer a morning - have to be home by about 1:30pm to get ready for work. This weekend I'm not busy.

As for dealing with unco-operative policemen, either threaten to make a complaint against him and ask for his superior until you get the help that has been ORDERED. Or take donuts with you. I'm sure he'd like some donuts - even though he doesn't deserve any.. Even if no action is taken, he'll still have to sweat on the complaint while it's investigated.

Best advice. If the constable won't help you go higher until you get someone who will. The cops HAVE TO enforce the order

Correct again. the house is still in their legal possesion, so they have every right to gain entry by any means that do as little damage as possible. Best one is drill the lock out.

DO NOT STAND BY AND LET THE LANDLORD WALK ALL OVER YOU. The last fight I got in was back in school, over 28 years ago. Since then I can intimidate most people just by my voice and actions. I am not a muscley person, have a bit of a gut but have successfully intimidated people to such an extent that they call the police, and run when they see me. Before anyone says anything, I have exercised great restraint in not taking one particular person shark fishing.... I'm sure he would be good bait.

This situation stinks. We spent all day trying to do things the "right" way today, and look what good it did us! And people wonder why on occasion people take the law into their own hands...

I used to have a lot of respect for the Police, however as a result of my dealings with them in this suburb, that respect is slowly disintegrating...

We're getting all our things back, it's just a matter of when, we have NOT given up, and we'll be seeking compensation from the slumlord land lord.
